House Republicans formally delivered articles of impeachment against Department of Homeland Security Secretary Alejandro Mayorkas to the Senate on Tuesday.

House Republicans voted to impeach Mayorkas in February by a razor-thin margin of 214-213, after initially failing to garner the necessary votes in an earlier attempt.

Mayorkas is the first sitting Cabinet secretary in American history to be impeached.

A group of House managers walked the articles across the Capitol to the Senate. The articles accused the Homeland Security head of “willfully and systematically” refusing to enforce immigration laws at the U.S.-Mexico border. Republicans also said he lied to Congress and broke the public’s trust by saying the border is secure.

The Democratic-controlled Senate will now decide whether and how to investigate the charges. Senate Majority Leader Chuck Schumer, D-N.Y., has called the impeachment a “sham.” With a simple majority, Democrats could dismiss the trial or table the articles, which would end the proceedings quickly.

Republicans say Mayorkas has eliminated policies that discouraged border crossings and implemented others, such as expanding humanitarian parole, that encourage migrants to come to the United States. The secretary and Democrats argue that it’s up to Congress to pass border security legislation.

Mayorkas, who has called House GOP’s allegations “baseless,” is unlikely to be removed from office. Conviction requires a two-thirds vote by the Senate, and Democrats control the chamber 51-49.
